The Second Circuit upholds Brian Flores's ability to pursue his claims in court, denying the NFL's request to force him into arbitration. Among other things, the Second Circuit holds that the NFL Constitution's arbitration clause is not entitled to enforcement under the Federal Arbitration Act, as it lacks all the traditional arbitral features including an independent decisionmaker.
